Tree Policy


The following is the Board’s interpretation and clarification of the Covenants and the insurance coverage regarding claims from falling trees.


The insurance coverage of the HOA covers claims resulting from live trees. However, the coverage does not cover the HOA if a tree that falls and causes damage is dead.


While the HOA retains the primary responsibility for maintaining the common space (Article VI of Covenants), since the coverage premium cost is borne by the entire community, it is imperative that individual homeowners notify the HOA when a tree is dead and can cause damage, injury or pose a risk to life.


In the event of a dead tree falling in which a homeowner had taken steps to notify the HOA in writing, but the HOA had not removed the tree, the HOA will bear the full cost of the damage. In the event of a dead tree falling in which a homeowner had not taken steps to notify the HOA in writing, but could have, the HOA has no responsibility for related damages and cost of removing the tree.
